Terms of Service

This page summarises the key terms of our moving and relocation services. The full contractual terms are set out in our General Terms and Conditions (based on the BKV/BCR standard April 2025 edition). In case of any conflict between this summary and the General Terms and Conditions, the General Terms and Conditions prevail.

Agreement to Terms

By accessing or using the services of moversclan BV ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, customers, and others who access or use our moving and relocation services.

Services Description

moversclan BV provides the following professional services:

  • Moving Services: Residential and commercial relocations within Belgium and internationally
  • Packing Services: Professional packing and unpacking of household items and fragile goods
  • Assembly Services: Furniture disassembly and reassembly at origin and destination
  • Lift Services: External elevator services for difficult-access buildings
  • Transport: Safe and insured transportation of your belongings
  • Storage: Short-term and long-term storage solutions in secure facilities

Service availability may vary based on location, timing, and specific requirements. We reserve the right to decline services at our discretion.

Booking & Cancellation Policy

Booking Process

To book our services, you may request a quote through our website, email, or phone. Upon receiving your request, we will provide a detailed quotation. A booking is confirmed only after you accept the quote and we confirm availability.

Cancellation by the Customer — Removal and Lift Services

Cancellation must be made in writing. The following compensation applies based on timing before the scheduled service date:

  • More than 7 days before: 10% of agreement amount
  • 3 to 7 days before: 25% of agreement amount
  • 1 to 3 days before: 50% of agreement amount
  • Less than 24 hours: 100% of agreement amount

Cancellation by the Customer — Storage Services

  • 3 to 7 days before scheduled start: 50% of one month's storage fee
  • 1 to 3 days before scheduled start: 75% of one month's storage fee
  • Less than 24 hours: 100% of one month's storage fee

Postponement

If the Customer requests postponement, all costs and damages caused by the postponement are borne by the Customer. If postponement is not feasible without disrupting our operations, it will be treated as a cancellation. If postponement exceeds 2 months without a new date agreed, the agreement is deemed cancelled.

Pricing & Payment Terms

Quotations

All quotations are valid for 30 days from the date of issue. Prices are based on the information provided by you. Additional charges may apply if:

  • The actual volume or weight exceeds the estimate
  • Access conditions differ from those described
  • Additional services are requested on the day of the move
  • Delays occur due to circumstances beyond our control

Payment

  • A deposit of 20-30% may be required to confirm your booking
  • The remaining balance is due upon completion of the move
  • We accept bank transfer, credit card, and cash payments
  • Late payments may incur interest at the legal rate

VAT Treatment

  • Business Customers: VAT is NOT included in quoted prices.
  • Consumers: VAT IS included in quoted prices.

Liability & Insurance

Our Liability

moversclan BV carries professional liability insurance. We are liable for loss or damage to Goods caused by our fault during performance of services, for damage to buildings at loading/unloading locations caused by our operations, and for delays caused by our fault.

Limitation of Liability

  • Maximum liability: EUR 125 per cubic meter of lost or damaged Goods.
  • Business removals: An additional exemption of EUR 750 per removal order applies to the total claim.
  • This limitation does not apply in cases of intent, gross negligence, or willful misconduct by moversclan BV.

Given this statutory limitation, we strongly recommend that Customers obtain "All-Risk" insurance covering the full replacement value of their Goods.

Exclusions

We are not liable for:

  • Force majeure events (natural disasters, war, strikes, etc.)
  • Acts of third parties beyond our control
  • Damage attributable to the Customer or their representatives
  • Goods packed by the Customer or third parties (we are only liable for external condition)
  • Valuable items not declared in advance (jewellery, cash, important documents)
  • Pre-existing damage, wear, or hidden defects
  • Damage to plants, perishables, or live animals
  • Indirect or consequential damages (loss of profit, data, business interruption, etc.)

Reporting Damage

  • Visible damage: must be reported immediately at the time of delivery on the delivery document, following joint inspection with our staff.
  • Non-visible (hidden) damage: must be reported by email or registered letter within 3 working days following delivery (excluding the delivery day).
  • Delay damage: must be submitted in writing within 2 working days after delivery, with proof that the damage actually resulted from the delay.

Statute of Limitations

  • Removal and lift services: all claims become time-barred 1 year after determination of the damage or the invoice date.
  • Storage services: all claims become time-barred 6 months from the date the Goods were returned.

Customer Responsibilities

As our customer, you agree to:

  • Provide accurate information about the items to be moved and access conditions
  • Ensure all items are ready for moving on the agreed date
  • Declare valuable items (over €500) in advance
  • Empty drawers and wardrobes unless otherwise agreed
  • Disconnect and prepare appliances for transport
  • Ensure safe and legal access to both origin and destination properties
  • Be present (or have a representative present) during the move
  • Clear pathways and parking areas where possible

Failure to meet these responsibilities may result in additional charges or limitations on our liability.

Prohibited Items

We cannot transport the following items:

  • Hazardous materials (explosives, flammables, corrosives, chemicals)
  • Illegal substances or contraband
  • Firearms and ammunition (without proper documentation)
  • Perishable food items (for moves longer than one day)
  • Live animals or plants (unless specifically agreed)
  • Items of extraordinary value without prior arrangement

Dispute Resolution

If we cannot reach a satisfactory resolution, you may submit your complaint to the Belgian Consumer Mediation Service or pursue legal action through the competent Belgian courts.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Belgium. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Leuven, Belgium.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the new terms.
